1. Who we are

These Terms & Conditions (the "Terms") govern your access to and use of the website operated by Erika Lodge ("Erika Lodge", "we", "us", or "our"). Our website and all content made available through it are referred to collectively as the "Site". Our contact details are set out in Section 16 below.

2. Acceptance of these Terms

By accessing or using the Site, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Site. If you are using the Site on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

3. Changes to the Site and these Terms

We may update the Site and these Terms from time to time to reflect changes to our services, our users needs, or legal and regulatory requirements. We will post the updated Terms on this page with a revised "Last updated" date. Your continued use of the Site after changes take effect constitutes acceptance of the updated Terms.

4. Eligibility

The Site is intended for users who are at least 18 years old, or the age of majority in your jurisdiction. If you are under 18, you may only use the Site with the involvement of a parent or guardian.

5. Accounts and security

If any part of the Site requires an account, you agree to provide accurate, current, and complete information and to keep it updated. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. Notify us immediately of any unauthorised use.

6. Bookings, payments & cancellations (if applicable)

From time to time, the Site may enable enquiries, reservations, or purchases for accommodation, tours, or experiences (collectively, "Bookings"). Specific booking terms (including pricing, deposits, cancellation terms, and refund eligibility) may be presented at the point of purchase or in a separate agreement. Where there is any conflict with these Terms, the specific booking terms will prevail.

7. Intellectual Property

The Site and all content on it—including text, graphics, photographs, images, audio, video, logos, icons, design, software, and the arrangement of such content (collectively, "Content")—are owned by or licensed to Erika Lodge and are protected by copyright, trade mark, and other intellectual property laws. All rights are reserved.

7.1 Licence to use the Site

We grant you a limited, non-exclusive, non-transferable, and revocable licence to access and use the Site solely for your personal, non-commercial use, subject to these Terms.

7.2 Image and media usage

• All photographs, videos, and other media on the Site (the "Media") are protected by copyright. You must not download, copy, reproduce, redistribute, transmit, publicly display, publicly perform, adapt, modify, or create derivative works from the Media without our prior written permission, except as permitted by applicable law.
• You must not use any automated means (including bots, scrapers, crawlers, or bulk download tools) to access, copy, or harvest the Media or other Content.
• You must not hotlink to the Media (i.e., display our images or videos on another site by linking directly to our files), use image proxying to bypass technical controls, or otherwise exploit bandwidth or storage resources associated with the Site.
• Any permitted use of the Media must retain all proprietary notices, watermarks, attribution, and metadata. Removing or altering copyright notices, EXIF data, or watermarks is prohibited.

8. User content

If you submit, upload, or post content to the Site ("User Content"), you grant us a worldwide, non-exclusive, royalty-free licence to use, reproduce, distribute, display, and perform that User Content in connection with operating and improving the Site. You promise that your User Content does not infringe anyone else's rights and that you have all necessary permissions to grant this licence.

9. Prohibited uses

• Use the Site for any unlawful purpose;
• Attempt to gain unauthorised access to the Site or related systems, or test the vulnerability of the Site without permission;

• Infringe our intellectual property rights or those of others.

10. Third‑party links and resources

The Site may contain links to third-party websites or resources. We are not responsible for the content, products, or services on or available from those websites or resources. You access any third-party websites at your own risk.

11. Privacy

We do not provide a Cookie Policy at this time; we will update our documentation if that changes.

12. Disclaimers

The Site and Content are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free, or that defects will be corrected.

13. Limitation of liability

To the fullest extent permitted by law, Erika Lodge and its directors, officers, employees, affiliates, agents, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Site; (b) any conduct or content of any third party on the Site; or (c) unauthorised access, use, or alteration of your transmissions or content.

14. Indemnification

You agree to defend, indemnify, and hold harmless Erika Lodge and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Site or your violation of these Terms.

15. Governing law and jurisdiction

These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by the laws of Peru. The courts of Peru will have exclusive jurisdiction.
